覆劉祖廸先生《沒有領土的香港議會?》

最近,劉祖廸先生在社交媒體上發文,用歷史上的「革命」事例分析,對香港議會的價值提出不少疑問。首先,香港議會籌委會感謝劉先生抽空撰文,分享他對「革命議會」的思考心得。我們的團隊也對文中的不少觀點作深入討論和反思,並希望藉此機會,闡述籌委會的理念和立場。

修讀歷史其中一個大忌是時代錯置 (Anachronism)。在大學課堂,教授會提醒學生,避免依賴學生所處時空的價值觀或標準來判斷歷史人事的成敗得失和意義。這道理反之亦然,歷史固然有其不可或缺的價值,但從中吸收智慧和經驗時,不應選擇性地過份強調某段歷史時期和當代之間的相似性,而無視兩者的時代差異。而且,既然要探討「革命」議題,就應該有革命性思維,避免限制視野,將歷史視為當代發展的範本。

「革命」一詞,在不同的時空,對不同人而言,有不同意義。劉先生的「光復藍圖」文章也闡述了其解讀。中國晚清辛亥革命、日本倒幕運動,的確無成立「議會」。但是,十九世紀不是講求民主的時代,乃至當時發揚民主的歐洲各國的「議會」也是只代表貴族、地主和男性利益的機構,直到二十世紀初才陸續有普選。在這種時代背景下,「革命」成功機會,更大程度取決於一少部份精英所掌握的武裝力量、財力等條件;「革命」義士也自然不會考慮先要有議會。晚清和幕末的「革命」,是在精英的主導下,以推翻政權為主要目標。「圓桌同盟」各組成團體各自代表自身理念和立場,在未有經過全民投票的過程前提下,無客觀標準反映其各自民意基礎,亦缺乏議事過程,確立各方都遵守之原則。例如,同盟會中,興中會主張「三民主義」,光復會只追求「光復漢族,還我山河」。是以同盟會內部紛爭不斷之時,初生的民國則被北洋軍閥勢力掌控,終至孫文要先後發動「二次革命」、「護法戰爭」,以至後來的「北伐」和遺害至今的「聯俄容共」。長遠而言,辛亥革命又是否「成功」?

劉先生提醒了我們,西藏議會內部分裂嚴重的問題。誠然,西藏議會為香港議會的眾多啟發之一,但籌委會也十分認同「香港人不能硬生生套用藏人的模式,應當摸索出一條屬於自己的路」。我們無計劃複製西藏議會。正如劉先生所言,理性的正反面討論是民主的重要一環。不同意見和主張之間角力、對壘是所有民主制度的必經過程。思想成熟的政治家之間會在議會上各不相讓,但心中卻會互相尊重對手;政客則不管是非黑白,在大是大非之時,依然為自己派系或個人利益互相攻擊、抹黑。但我們認為這是從政者的修為及對民主精神的覺悟,不是議會制度本身問題。籌委會的角色是建立由所有香港人主導的議政平台。我們不會先入為主,質疑香港人民的智慧,亦不認為因為其他組織的經驗,就可以斷言香港議會將無所作為,或者會陷入類似的政治鬥爭。

對香港人而言,「光復香港,時代革命」到底代表甚麼,在近年來有各種觀點和辯論,例如滅共、脫離中共殖民統治、獨立自主、歸英等等,不能盡錄。然而,無論屬何種「革命」,背後都是對香港前途的宏大願景,並非遊行示威,只追求政權作出讓步,達成示威者的幾項條件的短期目標。在講求全民民主的二十一世紀,香港的「革命綱領」,必須由全體香港人民決定和授權;一人一票產生的香港議會對「革命」的作用就在於此。

建立香港議會的目的,由始至終都是為了光復香港,絕不是回到香港這塊土地上才開始組成參與管治的議會。如果有領土或治權,香港已經光復,根本無必要建立海外議會。籌委會不認為「領土」、「治權」和「兵權」是決定香港議會力量的唯一標準。反之,「民意授權」才是香港議會力量和國際認受性的來源,所以籌委會才會不斷研究投票方案安全性,務求令身處香港的選民都能安全地參與選舉,不會被排除在外。

至於「兵權」問題,籌委會的角色是籌備第一次選舉,在「光復香港」的大原則之下維持中立,不會支持或反對任何「光復香港」的方案,包括建立香港武裝力量。但是,就算今天已經建立一支民兵團,亦需要經人民授權,才能成為真正屬於香港人的武裝力量。美國獨立戰爭,大陸軍亦需經大陸會議(Continental Congress),由各州代表決議批准建立,才真正成為屬於十三州的正式軍事力量。

更重要的是,要建立武裝力量殊不簡單,需要十分周詳的計劃和長時間準備和訓練。我們這些有幸離開險境,安身海外的香港人,呼吸自由的空氣,人身自由和安全受到保障,自然有時間和本錢可以高談闊論革命大戰略。但是,籌委會並沒有忘記仍在香港的人民,以致身陷牢獄的手足,全部都正處於水深火熱之中,每一刻都是中共強權的身心摧殘。到底他們有多少時間和忍耐力,才會等到有「兵權」有「治權」、有「領土」的「議會」出現的一天?如果要分先後次序、緩急輕重,在香港人被中共滅聲、本土文化被摧毀、身份認同被否定、下一代被荼毒之時,盡快為他們建立可以讓他們向全世界發聲的議會,孰緩孰急?

最後,籌委會感謝劉先生對光復香港大業不遺餘力,現誠邀劉先生參加香港議會選舉,將他的革命理念和宏圖大計,交給香港人民用選票決定。同時,籌委會亦呼籲一眾前區議員、前立法會議員,以及對公職有承擔的人士,慎重考慮參選香港議會。

Richmond resident, former Sing Tao editor on Hong Kong’s wanted list

A Richmond resident and former editor of a Chinese-language newspaper has been placed on the Hong Kong Security Bureau’s (HKSB) wanted list earlier this month.

Victor Ho was one of three activists placed on the list with the HKSB announcing in a news release that it “severely condemns” them for forming a “Hong Kong Parliament” overseas and subversion under the National Security Law.

The National Security Law was imposed on Hong Kong by Beijing in response to pro-democracy protests in 2019.

According to the Chinese government, people found to have fallen foul of the law “shall be sentenced to life imprisonment or fixed-term imprisonment” for a determined number of years.

HKSB made the announcement shortly after Ho and other activists joined a news conference in Toronto on July 27 to reveal the establishment of a committee for a Hong Kong “parliament in exile” that would go against Beijing’s crackdown on political freedom.

“On the basis of Article 37 of the National Security Law, Police shall spare no efforts in pursuing the cases in accordance with the law in order to bring the offenders to justice,” reads the HKSB news release.

“The Security Bureau appeals to the public to disassociate themselves from individuals contravening the Hong Kong National Security Law, and the illegal activities those individuals organized, so as to avoid bearing any unnecessary legal risks.”

However, Ho told the Richmond News that it was a surprise to find out he was wanted by the HKSB, although he is not too worried and actually wants to “thank” the security bureau for it.

“I never received any notifications directly by the Hong Kong government, but for them to put my name on that list means people in Hong Kong and internationally will know what we are doing,” said Ho.

He added that, because the city’s government has tight control of the media, it is difficult for many local publications to write anything related to democracy without punishment.

“The government basically volunteered themselves to announce that we are fighting for political democracy.”

Meanwhile, a group of Canadians with Hong Kong ties have written an open letter to Prime Minister Justin Trudeau and Foreign Affairs Minister Melanie Joly to show their discontent regarding the Hong Kong government’s actions.

“It is appalling that a Canadian citizen exercising his freedom of expression and freedom of association in Canada, with his rights and freedom entrusted by our constitution, could be charged and wanted by a foreign government,” reads the letter.

Being on Hong Kong’s wanted list has “serious and unpredictable implications” for Ho and his family members, according to the aforementioned group’s spokespersons Bill Chu and Thekla Lit.

“While Victor is relatively safe in Canada, we are concerned for his safety were he to travel to countries that have extradition agreements with Hong Kong and China,” they said.

Canada suspended its extradition agreement with Hong Kong shortly after the National Security Law was put in place, which is a reassurance for the group.

However, members of the group find the incident alarming that Canadian citizens could land themselves on the Hong Kong government’s wanted list for exercising their freedom of expression.

Chu and Lit added that the “incident is a serious violation of democratic rights here in Canada, as others following Victor may similarly face persecution from the Hong Kong and Chinese government(s) for lawful expressions and actions in Canada.”

香港保安局周三(3日)發聲明嚴厲譴責,指袁弓夷、何良懋、梁頌恆涉嫌違反《港區國安法》第22條「顛覆國家政權」罪。

一批海外港人上周三(27日)在加拿大多倫多宣布成立「香港議會選舉籌備委員會」,事隔一星期,香港保安局周三(3日)指他們涉嫌違反《港區國安法》而被通緝。「香港議會」的發起人袁弓夷向本台表示,早就收過來自北京國安的警告,反映建立「香港議會」正中北京的要害,而「香港議會」回應指,被非法不義的政權通緝是榮幸,強調不會向獨裁者低頭,會繼續籌備「香港議會」。

香港保安局周三(3日)發新聞稿表示,「嚴厲譴責袁弓夷、何良懋及梁頌恆等人在海外籌組所謂『香港議會』,涉嫌違反《香港國安法》第22條『顛覆國家政權』罪」,保安局又指,警方會根據《香港國安法》第37條依法追究,將上述人士緝捕歸案,又呼籲市民要與任何違反《香港國安法》的人士及他們組織的非法活動劃清界線,以免承擔不必要的法律風險。

袁弓夷向本台表示,今次被通緝反而有助澄清一些被指「中共白手套」的謠言,又透露自己早就收過來自北京國安的警告,所以一早有心理準備。

袁弓夷說:現在他們最大的問題,整個中國,不單只是香港,都是沒有人代表,沒有人民代表,所以整個政府的合法性、代表性是不存在的,每次提起要公投、要投票, 就會捉到他痛處。他事先都有警告過我, 但我沒有理會,不是香港,是北京那邊的國安,國家安全(單位)有幾個途徑曾經警告過我,指我還有家人在香港。(那麼香港的家人擔心嗎?現在有可能連累你家人)擔心都沒有用,我都出走那麼久,說了那麼多話,嚴重過香港議會的事講得更多。

袁弓夷媳婦、新民黨議員容海恩馬上與家翁劃清界線,同日在Facebook發文批評,「梁頌恆、袁弓夷及何良懋等人在海外籌組所謂的『香港議會』,毫無疑問是一個有計劃、不顧一切後果、全心惡意顛覆特區政府職能以及破壞特區政府的組織」,她又表明全力支持警方打擊所有違法活動,以儆效尤。

「香港議會」在社媒上回應表示,被這個非法不義的政權通緝是其榮幸,又認為法治或法律的合法性是建立在人民同意的基礎上,所以「不論是所謂的《國安法》,或是引用《國安法》通緝香港議會籌備委員會委員的所謂『香港政府』,卻是完全沒有香港人的授權,遑論同意。我們籌組一個能真正代表香港人的香港議會,卻被一個沒有人民授權的「政府」通緝,只會令世界覺得無稽和可笑」,籌委會又表明不會向獨裁者低頭,並會繼續籌備香港議會。

香港人袁弓夷、何良懋、梁頌恆等人上周三(27日)在加拿大多倫多,宣布成立「香港議會」選舉籌備委員會,正式啟動籌組「香港議會」的選舉工作,並希望明年稍後舉行一場全球港人均可參與的普選,選出一群在國際上代表香港人發聲的香港議會成員。

袁弓夷為時事評論員袁彌昌及人民力量前主席袁彌明之父,同時為新民黨議員容海恩的家翁,袁弓夷於「反送中運動」開始活躍評論時政,其後離港;何良懋則曾任海外版《星島日報》,不時與袁弓夷一同主持網上論政節目。梁頌恆則曾為青年新政前召集人,2016年於立法會宣誓後被取消議員資格,「反送中運動」後流亡美國。

Overseas activists launch exiled Hong Kong ‘parliament’ plan, as gov’t says security law has ‘extraterritorial effect’

The Beijing-imposed national security law has “extraterritorial effect,” Hong Kong’s Security Bureau has said, as a group of overseas Hong Kong citizens launch a committee to establish a “Hong Kong Parliament” in exile.

The Hong Kong Parliament Electoral Organizing Committee was founded this month in Canada. It aims to hold the first election of the parliament in late 2023, the group said in a statement on Wednesday. One of the organising members is ex-lawmaker-elect Baggio Leung.

Leung was among the growing list of pro-democracy figures who left the city to go into self-exile. The 35-year-old said he sought asylum in the US in December two years ago, after the implementation of the security legislation.

“It is the Committee’s belief that only a genuine democratic election could literally [speak up] for the people Hong Kong,” a statement read.

In a response to HKFP, the Security Bureau said that while they would not “comment on individual cases, the national security law “clearly stipulated all elements of four categories of offences endangering national security.” 

“It should also be pointed out that the [security law] has extraterritorial effect. Any persons or entities who violate the [security law], regardless of their background, or where they are located, will be dealt with by the HKSAR Government in accordance with the law” the bureau said on Wednesday. The spokesperson did not elaborate on how the law would be enforced abroad.

Leung was one of the first lawmakers to be disqualified as an incoming lawmaker in Hong Kong after he was elected in 2016. He protested during the Legislative Council’s swearing-in ceremony by mispronouncing his oath, and draped himself in a “Hong Kong is not China” flag.

Belief in ‘Popular Sovereignty’

According to the organising committee, the parliament, which will be formed by universal suffrage “represents, solidifies and revives Hong Kong people’s rights of self-determination.”

The scheme was initiated by businessman and commentator Elmer Yuen, who is the father of ex-People Power chair Erica Yuen and scholar Derek Yuen, who is married to New People’s Party lawmaker Eunice Yung.

The committee is chaired by journalist Victor Ho, who is the former editor-in-chief of the Vancouver edition of Sing Tao Daily.

Their statement said: “The Committee believes in Popular Sovereignty. Hongkongers should as of right decide Hong Kong’s future. To exercise this principle, Hongkongers must elect their representatives by free, fair, and safe elections which meet the international standard.”

The sweeping security legislation, enacted in June 2020, criminalised subversion, secession, collusion with foreign forces and terrorist acts, which were broadly defined to include disruption to transport and other infrastructure.
